Terms and Conditions

1. Acceptance of Terms

By accessing or using any part of the iximiuz Labs platform (“Platform”), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions (“Terms”). If you do not agree with any provision herein, you must not access or use the Platform.

2. Definitions

PlatformThe web service, APIs, sandbox environments, and associated tooling operated by iximiuz Labs.
LearnerAn individual who consumes learning materials or laboratory environments hosted on the Platform.
Content Author ("Author")A user who publishes tutorials, challenges, skill paths, courses, or other learning assets on the Platform.
Instructor / Trainer ("Instructor")A user who organises and delivers instructor‑led trainings ("ILTs") through the Platform's dedicated ILT features.
Instructor‑led Training (ILT)A scheduled learning session—virtual or in‑person—in which an Instructor guides one or more Learners using materials and/or laboratory resources provided via the Platform.

3. Data Usage and Privacy

  1. Cookies are used solely for authentication.
  2. Personal data collected: GitHub public profile ID, optional display name, and any additional profile links supplied by Authors or Instructors.
  3. No personal data is sold or shared with third parties except when you voluntarily interact with external services (e.g., Kit, Patreon, Gumroad, Creem.io). Those interactions are governed by the respective third‑party terms.
  4. Email addresses and payment details are processed exclusively by the above‑mentioned providers; iximiuz Labs never stores them.
  5. Data collected directly by iximiuz Labs remains confidential.

4. User Roles and Conduct

4.1  Learners

Learners must:

  • Engage respectfully with all users.
  • Refrain from hateful, unlawful, or disruptive behaviour.
  • Avoid submitting sensitive data or executing prohibited activities (e.g., unsolicited e‑mail, cryptocurrency mining, large‑scale network scanning).
  • Report security concerns via responsible disclosure; any malicious attempt to compromise the Platform is strictly forbidden.

4.2  Content Authors

Authors may publish content within the Platform’s thematic scope (Linux, networking, containers, Kubernetes, security, observability, CI/CD, server‑side, system programming). Authors:

  • Retain full ownership of their material.
  • May remove their content at any time.
  • Must ensure content is accurate, lawful, and non‑infringing.
  • Grant iximiuz Labs a non‑exclusive right to host and display the content. iximiuz Labs may delist or delete content that violates these Terms or the thematic scope and may permanently ban repeat offenders.

4.3  Instructors / Trainers

Instructors deliver ILTs using Platform‑supplied lab environments, slides, or third‑party conferencing tools. Instructors must:

  • Ensure the legality and safety of any material or code executed during ILTs.
  • Obtain all necessary permissions for third‑party works incorporated into an ILT.
  • Conduct sessions professionally and respectfully.
  • Not advertise or conduct ILTs for purposes outside the Platform’s thematic areas without prior written consent from iximiuz Labs.
  • Provide accurate scheduling details; any cancellations or schedule changes must be communicated promptly to enrolled Learners.
  • Acknowledge that iximiuz Labs is not a party to financial transactions between Instructors and Learners (if any) and provides no payment processing, escrow, or dispute‑resolution service.

5. Instructor‑Led Training (ILT) Usage Terms

  1. Resource Allocation. Labs and virtual machines used during an ILT are provisioned on a best‑effort basis. High utilisation may delay spin‑up times.
  2. No SLA/SLO. iximiuz Labs offers no service‑level agreement or service‑level objective for ILT uptime, performance, or support response times.
  3. Recording and Privacy. Recording of ILTs is permitted only with explicit consent from all participants. Instructors are solely responsible for obtaining and retaining such consent.
  4. Liability. iximiuz Labs bears no responsibility for any outcome (financial, reputational, or otherwise) resulting from an ILT, including—but not limited to—misstatements by an Instructor, equipment failure, or learner dissatisfaction.

6. Platform Availability, Warranty Disclaimer, and Limitation of Liability

The Platform and all content are provided “AS IS” and “AS AVAILABLE.”

No express, implied, or statutory warranty (including merchantability, fitness for a particular purpose, non‑infringement, or quiet enjoyment) is given. iximiuz Labs makes no representation that the Platform will operate uninterrupted or error‑free, or that defects will be corrected.

To the maximum extent permitted by applicable law:

  • iximiuz Labs shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages (including lost profits, loss of revenue, business interruption, loss of data, or other economic loss) arising out of or related to the use of—or inability to use—the Platform, even if advised of the possibility of such damages.
  • Your sole and exclusive remedy for dissatisfaction with the Platform is to stop using it.

7. Intellectual Property

Users receive a limited, non‑exclusive, non‑transferable licence to access the Platform for personal or educational use. Any unauthorised reproduction, distribution, or modification of Platform content or software is prohibited.

8. Modifications to the Platform or Terms

iximiuz Labs may update the Platform or these Terms at any time, with changes taking effect upon posting. Continued use after an update constitutes acceptance of the revised Terms.
